Welcome to Craftworks! These Terms of Service ("Terms") govern your access to and use of our platform, services, and applications (collectively, the "Service"). By accessing or using Craftworks, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Service.

1. Overview of the Service

Craftworks is an online commerce platform that connects retailers and producers. Retailers place orders for products, which are routed to producers for manufacturing and fulfillment.

Craftworks acts as an intermediary platform, not as the seller or manufacturer of any goods listed or ordered.

2. Eligibility

• Be at least 18 years old
• Be authorized to act on behalf of a legal business entity
• Provide accurate and complete registration information

You may not use the platform for any unlawful or unauthorized purposes.

3. Account Registration

You may register as either a Retailer or a Producer. You agree to:

• Provide accurate information
• Keep your credentials secure
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that provide false or incomplete information.

4. Orders and Fulfillment

Retailers may place product orders via the platform. These orders are transmitted to selected producers.

• Craftworks is not a party to the sales contract between retailers and producers.
• Producers are solely responsible for manufacturing, delivery, warranties, and compliance.
• Retailers are responsible for payments, correct order data, and customer communications.

5. Payments

Craftworks does not handle or process payments directly. Payment terms are agreed between retailers and producers.

If integrated payment services are introduced in the future, they will be governed by additional terms.

6. Platform Fees

Use of the platform is currently free for basic access. If fees are introduced, users will be notified in advance.

7. Intellectual Property

All content and software used in the Service are owned by Craftworks or its licensors and are protected by intellectual property laws.

• You may not reproduce or distribute any part of the Service without permission.
• You retain ownership of your own content (e.g., product listings) but grant Craftworks a license to use it for platform functionality.

8. Data and Privacy

Our data practices are outlined in our Privacy Policy. By using the Service, you consent to the collection and processing of data as described.

We strive to store all user data in the EU and comply with GDPR regulations.

9. Termination

We may suspend or terminate access if:

• You violate these Terms
• Your actions harm other users or disrupt the platform
• We are legally required to do so

You may delete your account at any time by contacting us. Order data may be retained for legal or operational reasons.

10. Disclaimers

Craftworks is provided "as is" without warranties of any kind. We do not guarantee performance, availability, or specific outcomes.

We are not liable for issues in the transaction or order fulfillment process between retailers and producers.

11. Limitation of Liability

To the extent permitted by law, Craftworks is not liable for:

• Lost profits or business
• Indirect or consequential damages
• Content or actions of third-party users

Our total liability will not exceed €100 or the amount you paid to us in the past 12 months.

12. Modifications to the Terms

We may update these Terms occasionally. Continued use after changes means you accept the updated Terms.

Please review them periodically.

13. Governing Law

These Terms are governed by the laws of Poland and the European Union. Any disputes will be handled by the courts of Poland.
